A motion to quash the case against Texas teen Justin Carter failed on Monday. With the motion quashed, he will continue on to trial, though the date for that has not been announced.

19-year-old Carter, who was arrested earlier this year for comments made on a Facebook page after a bad game of League, could be put in prison for eight years if found guilty.

After another player called him insane, Carter responded with the following statement:

Oh yeah, I’m real messed up in the head, I’m going to go shoot up a school full of kids and eat their still, beating hearts.

The comment has since been labeled as sarcastic, but the conversation was reported by a Canadian woman who believed he was a risk after finding out that Carter actually lived near an elementary school. Since then, Carter and his counsel have been attempting to get the case thrown out of the Comal County, Texas, court.

Now that their motion has failed, Lawyer Don Flanary previously stated that if the court failed to dismiss the charges, that there were “many other avenues to take it up on appeal… I think the law is definitely on our side.”
